GENERAL TERMS AND CONDITIONS

The General Terms and Conditions of the online store "www.rodica.si" are compiled following the Consumer Protection Act (ZVPot) and based on the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for online and electronic business.

The online store "www.rodica.si" is an information system intended for the presentation and sale of products to users. It is managed by Marinko Rodica, Truške 1C, SI-6273 Marezige, hereinafter referred to as the provider.

A user is a person who accesses the online store "www.rodica.si", hereinafter referred to as the customer.

By visiting the website and submitting an inquiry, the customer confirms that he is familiar with the entire text of the General Terms and Conditions on the website "www.rodica.si" and fully agrees with them.

AVAILABILITY OF INFORMATION

The provider is obliged to ensure the purchaser the following information:

  • Identity of the company (name and head office)
  • Contact details which enable the user to communicate quickly and efficiently (E-mail and telephone number)
  • Essential characteristics of goods
  • Terms of delivery (costs, shipping method, and time of delivery)
  • Clear and unambiguous marked prices and an evident display whether they already include taxes and costs of delivery
  • A possible method of payment
  • Period of validity of the offer

CONCLUSION OF THE SALES CONTRACT

The purchaser who wishes to conclude a sales contract with the provider for the purchase of the provider's products must send the provider a purchase request via the "INQUIRY" form. The purchaser can submit an inquiry any day of the week 24 hours a day.

The purchaser must enter the following information in the "INQUIRY" form. The following information is mandatory for the validity of the inquiry:

  • Name and surname of the purchaser
  • Address of the purchaser
  • Phone number of the purchaser
  • E-mail address of the purchaser

The purchaser is responsible for the data given in the process of submitting the inquiry.

After receiving the purchaser’s complete inquiry for his products, the provider will make an offer with a proforma invoice which will be sent to the customer's e-mail address. The provider will make the offer the next day or no later than three days from the receipt of the purchaser's request. The offer is valid for seven working days from the date stated in the offer, after which the provider’s offer is no longer binding for the provider.

In the offer, the provider will specify the products for which the purchaser has submitted an inquiry with the prices as they appear from the respective pricelist of the provider and with the delivery costs. It will also provide the information needed to make a successful payment.

The provider may change the offer upon the receipt of a written request from the purchaser for a change of the offer which the purchaser submits to the provider’s e-mail address info@rodica.si within the period of validity of the offer. The sales contract is concluded when the purchaser transfers the full value of the products and delivery costs to the provider’s bank account.

Upon payment of the full value of the proforma invoice, the proforma invoice is considered an invoice.

IMPORTANT NOTICE

Dispensing and delivery of wine and spirits may only be carried out to persons over 18 years of age. Therefore, the purchaser must be of legal age at the time of placing the order. Otherwise, the provider withdraws from the contract. By agreeing to the General Terms and Conditions, the purchaser confirms that he or she is over 18 years of age.

PRICE

The provider sells its products at the prices listed next to the products on the website. The prices are displayed clearly and unambiguously.

The listed prices are in euros and include VAT but do not include delivery costs.

The provider reserves the right to change prices. The valid price is the one published on the day of the order, i.e. on the day of the completion and submission of the order.

All prices are valid only for electronic ordering of products through the form "INQUIRY" submitted on the website "www.rodica.si".

METHOD OF PAYMENT

The provider only ensures payment by proforma invoice by transfer to the provider’s bank account which is stated on the proforma invoice.

SHIPMENT OF PRODUCTS, DELIVERY, AND DELIVERY COSTS

The provider will ship the products within three working days after receiving the full payment according to the offer.

For the provider, the delivery is performed by the companies INTEREVROPA d.d., Globalni logistični servis, Vojkovo nabrežje 32, 6000 Koper, registration no. 5001684, and DPD, kurirska in paketna distribucija, d.o.o., Celovška cesta 492, 1210 Ljubljana. The provider reserves the right to choose another delivery service.

The provider calculates the costs of delivery in the territory of the Republic of Slovenia in accordance with the currently valid pricelist of the delivery service and is bound by the weight of the shipment (ordered products of the provider). For orders over 50 euros, including VAT, the delivery is free. Delivery costs are not included in the price of the products but are defined in the proforma invoice.

The provider calculates the delivery costs to the remaining countries in accordance with the currently applicable price list of the delivery service, which is stated on the proforma invoice.

The delivery time of the ordered goods depends on the general terms and conditions of the delivery service and the provider is not responsible for it.

In the event, if the package in which the customer received the ordered products is physically damaged, if a part of the order is missing, or if it shows signs of being opened, the customer must report the complaint to the delivery service and send it to the provider for information to the email address info@rodica.si.

The delivery service is responsible for the loss or damage of the shipment. In case of damage or loss of the shipment, the provider sends a new shipment after the notification from the purchaser who sends it to the provider's e-mail address info@rodica.si.

WITHDRAWING FROM THE CONTRACT AND THE REFUND OF THE PURCHASE PRICE

In accordance with the Consumer Protection Act (ZVPot) the purchaser has the right to withdraw from the order within 14 days of receiving the products.

The purchaser can return the provider's products based on a notification to the provider's e-mail address info@rodica.si.

The purchaser must return the provider's products to the provider no later than 14 days from the submitted notice of withdrawal from the contract.

The customer must return the products undamaged, originally packaged, and in the same quantity to the address Marinko Rodica, Truške, Truške 1C, SI-6273 Marezige.

When returning the products, the purchaser must enclose a copy of the proforma invoice, personal data, and the number of the transaction account to which the purchase price will be returned.

The cost of returning the products is paid in full by the customer.

The provider will return the entire purchase price to the purchaser within 15 days of receiving the returned products.

REJECTION OF THE ORDER

The provider reserves the right to reject the order for which he finds out that he cannot carry it out.

COMPLAINTS

If the delivered products of the provider show any defects (in quality, quantity, or type of ordered products), the purchaser must complain to the provider no later than two months from the discovery of the ascertained defect. Otherwise, he or she loses the rights he or she has according to the Consumer Protection Act (ZVPot) and the Obligations Code (OZ).

The provider will resolve complaints in accordance with applicable law and will strive for the most favorable solution.

SECURITY OF THE ONLINE STORE

The provider provides appropriate technological means and security and protection systems that provide adequate protection against data loss or misuse.

DATA PROTECTION

The provider pledges to protect all personal data of the purchaser permanently. They will be used exclusively for managing invoices, offers, and other necessary documentation. The user will not pass the data on to unauthorized third parties.

To perform the purchase in the online shop, the provider needs the following personal data:

  • Name and surname of the purchaser
  • Address of the purchaser
  • Phone number of the purchaser
  • E-mail address of the purchaser

The personal data protection policy published on the website "www.rodica.si" applies to the submitted personal data of the customer.

FINAL PROVISIONS

The provider will strive to deal with the complaint as soon as possible and inform the purchaser about it.

The provider will strive to resolve any disputes with the purchaser in a peaceful manner. If this is not possible, however, the jurisdiction of the courts in the Republic of Slovenia is determined for disputes between the provider and the purchaser.

The contractual relationship between the provider and the purchaser is governed by the law of the Republic of Slovenia, in particular the provisions of the Consumer Protection Act (ZVPot) and the Obligations Code (OZ).

The Provider reserves the right to change the General Terms and Conditions at any time or without prior notice. The change of the General Terms and Conditions is valid from the day of publication on the website "www.rodica.si".
